1. Information We Collect

Because HytchUp facilitates communication and relationship management, we collect the following categories of personal data:

a. User-Provided Data: Name, Email address, Phone number, profile photos, account credentials, and payment information processed by third-party providers (e.g., Stripe). HytchUp does not store full card details.

b. Communication Data: Message content and logs exchanged between riders and drivers within the platform, along with metadata such as timestamps. This data may be reviewed for safety, fraud prevention, and service quality.

c. CRM & Usage Data: Interaction history, notes, preferences, feature usage, and engagement data created by users to manage their business relationships.

d. Device & Location Data: IP address, device identifiers, browser type, and precise location data (GPS) to facilitate matching and real-time trip functionality.

2. Legal Bases for Processing (GDPR)

For users in the European Economic Area (EEA), we process personal data under the following legal bases:

• Contractual Necessity: To provide core platform functionality and fulfill our terms of service.

• Legitimate Interests: To improve our services, ensure platform safety, and prevent fraudulent activity.

• Consent: Where you have given clear permission, such as for SMS marketing or optional data sharing.

• Legal Obligation: To comply with tax, regulatory, or law enforcement requirements.

3. Cookies and Tracking Technologies

5. Data Sharing and Disclosure

We do not sell personal data. Limited information such as name, photo, and location may be shared between riders and drivers to facilitate interactions.

We share data with vetted third-party providers for hosting, payment processing, and analytics. These providers process data solely under our instructions.

SMS Data Privacy: Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. International Data Transfers

HytchUp is headquartered in the United States. If you are accessing the Service from outside the U.S., your data will be transferred to and processed in the United States.

We utilize Standard Contractual Clauses (SCCs) or other approved legal mechanisms to ensure your data receives an equivalent level of protection as required by your home jurisdiction.

7. SMS Communications (10DLC)

By providing your mobile number, you may opt-in to receive SMS communications regarding trips, account alerts, or support.

Consent: Opting in to receive SMS messages is not a condition of purchase or a requirement to use the platform.

Opt-Out: You may unsubscribe at any time by replying STOP to any message you receive.

Frequency: Message frequency varies based on your interactions. Message and data rates may apply.

8. Data Retention

We retain personal data, including SMS logs, only for as long as necessary to provide the Service, resolve disputes, or comply with legal obligations.

When data is no longer required, it is securely deleted or anonymized so that it can no longer be associated with an individual.

9. Your Privacy Rights (GDPR / CCPA / CPRA)

Depending on your location, you have the following rights:

• Access & Portability: Request a copy of your personal data.

• Correction & Erasure: Fix inaccurate information or request the 'right to be forgotten.'

• Objection & Opt-out: Object to processing or opt out of the 'sale' or 'sharing' of data for cross-context behavioral advertising.

HytchUp is not intended for individuals under 18 years of age. We do not knowingly collect data from children. If we learn we have collected data from a minor, we will delete it immediately.

We may update this policy periodically. Continued use of the Service after the Effective Date constitutes acceptance of the revised terms.
